Ohio’s Peer Review Protection: Under Attack

Peer review protections for Hospital incident reports and risk management reports are being incrementally eroded. Everyone thought that the issue of whether incident reports/risk management reports were protected by Ohio's peer review privilege was put to rest with the amendment of Ohio's peer review statutes several years ago. At that time, R.C. 2305.253 was enacted specifically stating that these documents were subject to peer review protection. However, in the past 2 years we have seen a growing number of cases where the courts have held that these documents are subject to discovery in medical malpractice cases because the reports have not been managed consistently with the definition of incident report/risk management report as set out in the statutory provisions. This session is designed to explore these cases and give direction on how to manage your incident reports/risk management reports whether they involve hospital personnel or members of your medical staff so that they remain protected.Key Topics

Catherine Ballard is a partner in the Bricker and Eckler health care department with a practice focusing on the day to day operations of a variety of healthcare facilities as well as those facilities’ dealings with administrative agencies and court proceedings. She works with clients in the areas of medical staff governing documents and related policies; credentialing; quality assessment/ improvement; peer review; accreditation; physician recruitment; and contract negotiations. Her clients include hospitals, managed care organizations, and health care related professional associations.
